Mango IT Terms of Use

Your Rights and Responsibilities When Using Our Website and Services

1. Acceptance of Terms

1.1 Agreement to Terms

By accessing or using the Mango IT website at mangoit.ca (the “Site”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and anyone else who accesses the Site.

By using this Site, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are accessing the Site on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

1.3 Changes to Terms

Mango IT reserves the right to update or modify these Terms at any time without prior notice. Changes are effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

2.1 Permitted Use

You may use the Site for lawful purposes only. Permitted uses include:

  • Browsing information about Mango IT’s services

  • Submitting contact or consultation requests

  • Accessing resources, guides, or other content made available by Mango IT

  • Communicating with our team through provided contact channels

2.2 Prohibited Activities

You agree not to use the Site for any purpose that is unlawful, harmful, or otherwise prohibited. Prohibited activities include, but are not limited to:

  • Attempting to gain unauthorized access to any portion of the Site or its related systems

  • Transmitting any malware, viruses, or other harmful or malicious code

  • Using automated tools (bots, scrapers, crawlers) to collect data from the Site without written permission

  • Impersonating any person or entity, or misrepresenting your affiliation with any person or entity

  • Engaging in any conduct that restricts or inhibits any other user’s use or enjoyment of the Site

  • Attempting to interfere with the proper functioning of the Site or any connected networks

2.3 Account Access

If you access any client portals, management tools, or password-protected areas linked from the Site, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. 3. Intellectual Property

3.1 Ownership

All content on this Site — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — is the property of Mango IT or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

3.2 Limited Licence

Mango IT grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal or internal business purposes. This licence does not include the right to:

  • Reproduce, distribute, or publicly display any Site content without written permission

  • Modify or create derivative works based on Site content

  • Use Site content for any commercial purpose on behalf of a third party

  • Remove or alter any copyright, trademark, or proprietary notices

3.3 Trademarks

The Mango IT name, logo, and associated marks are trademarks of Mango IT. All other trademarks, service marks, and logos appearing on the Site are the property of their respective owners. Nothing in these Terms grants you any right to use any trademark without the prior written consent of the owner.

4. Disclaimer of Warranties

4.1 “As Is” Basis

The Site and all content, information, materials, and services provided through it are offered on an “as is” and “as available” basis, without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, Mango IT expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement

  • Warranties that the Site will be uninterrupted, error-free, or free of viruses or other harmful components

  • Warranties regarding the accuracy, completeness, or currency of any information on the Site

4.2 General Information Only

Content on this Site is provided for general informational purposes only and does not constitute professional IT, legal, financial, or other advice. You should not act on any information from the Site without first obtaining appropriate professional guidance tailored to your specific situation.

5. Limitation of Liability

5.1 Indirect Damages

To the fullest extent permitted by applicable law, Mango IT and its directors, employees, agents, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of — or inability to use — the Site or its content.

5.2 Cap on Liability

In no event shall Mango IT’s total liability to you for all claims arising from your use of the Site exceed the amount you have paid to Mango IT in the twelve (12) months preceding the event giving rise to the claim, or CAD $100.00, whichever is greater. This limitation applies regardless of the legal theory under which the claim is asserted.

5.3 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

The Site may contain links to third-party websites for your convenience and information. These links do not constitute endorsement of those websites or any content, products, services, or other materials offered through them. Mango IT has no control over, and assumes no responsibility for, the content or practices of any third-party websites.

6.2 Third-Party Services

We use third-party platforms to operate our website and deliver services, including Wix (website hosting), Microsoft 365 (email and cloud services), and others described in our Privacy Policy. Your use of these services through our Site may also be governed by those providers’ terms.

7.1 Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, and disclose your personal information in accordance with Canadian privacy law, including PIPEDA and BC’s PIPA. 8.1 Your Obligation to Indemnify

You agree to indemnify, defend, and hold harmless Mango IT and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of any third party’s rights, including intellectual property rights

  • Any content you submit or transmit through the Site

9. Governing Law + Dispute Resolution

9.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

9.2 Jurisdiction

Any dispute arising out of or relating to these Terms or your use of the Site shall be submitted to the exclusive jurisdiction of the courts located in British Columbia, Canada. By using the Site, you irrevocably consent to the personal jurisdiction of those courts.

9.3 Good Faith Resolution

Before initiating any formal dispute process, we encourage you to contact us directly at hello@mangoit.ca. Many concerns can be resolved quickly through open communication, and we are committed to working with you in good faith.

10. Termination + Access

10.1 Right to Restrict Access

Mango IT reserves the right, in our sole discretion, to restrict, suspend, or terminate your access to all or any part of the Site at any time, for any reason, without notice or liability. Reasons may include but are not limited to violation of these Terms, harmful conduct, or legal requirements.

10.2 Effect of Termination

All provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, indemnification, and limitations of liability — shall survive any termination of your access to the Site.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable service agreements, constitute the entire agreement between you and Mango IT regarding your use of the Site and supersede all prior understandings, agreements, representations, and warranties relating to that subject matter.

11.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any provision will be effective only if given in writing and signed by Mango IT.

11.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. Mango IT may assign its rights and obligations under these Terms without restriction.
